It is important that a national statute sets out a specific disciplinary offence amounting to knowingly issuing improper superior orders, including a high-ranking officer.


Out of analyzed legal frameworks, only BiH law contains the misdemeanor offence of knowingly issuing unlawful order by a superior, which potentially may include a high-ranking officer in the capacity of perpetuators. On the other hand, none of legal framework foresees an offence of knowingly issuing an unethical superior order.
