Indicator 2. Availability of judicial review – the law entitles the whistle-blowers to a fair hearing before an impartial forum with a full right of appeal. The law covers all direct, indirect and future consequences of reprisal and provide redress (i.e. resuming employment after unfair dismissal, a transfer to a comparable job, or compensation for detrimental treatment that cannot be remedied by injunctions such as unemployment and distress)

National legislation must encourage whistleblowers by presctibing sanctions for persons who prevent the whistle-blower from filling a report or who take revenge on the whistleblower of persons close to him/her.

Legislation of Bosnia and Herzegovina at federal level do not provide availability of judicial review and doesn’t provide availability of judicial review and doesn’t cover all direct, indirect and future consequences of reprisal and also doesn’t provide redress (i.e. (i.e. resuming employment after unfair dismissal, a transfer to a comparable job, or compensation for detrimental treatment that cannot be remedied by injunctions such as unemployment and distress). Montenegrin regulation requires additional improvements and legislation of other countries is fully in line with international standards.
