Sound legal framework on FAI recognizes the right to information as a fundamental right. Further, it creates a specific presumption in favour of access to all information held by public authorities, subject only to limited exceptions.

When it comes to creating a specific presumption in favour of access to all information the situation is not uniform: in BiH there is such a presumption, while in Kosovo, Montenegro and North Macedonia it is subject to a number of caveats.
