Sound legal framework on FAI recognizes the right to information as a fundamental right. Further, it creates a specific presumption in favour of access to all information held by public authorities, subject only to limited exceptions.
The legislations of Montenegro, Kosovo and North Macedonia recognise the right to information as a human right, while BiH legislation does so only implicitly. When it comes to creating a specific presumption in favour of access to all information the situation is not uniform: in BiH there is such a presumption, while in Kosovo, Montenegro and North Macedonia it is subject to a number of caveats.
