Standard 2. Free access to information applies to a wide scope of information holders

The right of access applies to the executive branch, the legislature, the judicial branch, including both administrative and other information. It also applies to State-owned enterprises, other public authorities, including constitutional, statutory and oversight bodies (such as an election commission or information commission/er) and to private bodies that are vested with public authority.

Summary

All the analysed countries envisage a broad scope of application of the FAI. The legislations of Kosovo, Montenegro and North Macedonia also envisage that FAI applies to state-owned enterprises, other public authorities and to private bodies that are vested with public authority. Conversely, RTI laws of BiH and of the analysed entities do not apply to private bodies that perform a public function
